Charter Flight Service Contract

This Charter Flight Service Contract (hereinafter referred to as the “Contract”) is considered an integral part of the Charter Flight Proposal submitted by AIR OCEAN MAROC (AOM), located at No. 1 Rue Battani, Agdal, Rabat, Morocco, for the provision of Charter Flight Services (“Service”). Any deviation from the terms and conditions set forth below shall only be valid if confirmed in writing by AOM.

  1. Flight Confirmation: This Contract shall be binding only if the client accepts the offer submitted by AOM in writing. Receipt of the client’s written confirmation will not be considered as confirmation of the Services by AOM and remains subject to aircraft availability, obtaining traffic rights, overflight permits, time slots, and all necessary governmental and operational approvals. If the required authorizations are not granted by third parties, AOM cannot be held liable. In such cases, AOM reserves the right to request compensation from the client for expenses incurred.

  2. Service Cost: The proposal covers the price of standard charter flight services including the following components, unless otherwise specified:
    • All operating costs related to the Service, including aircraft, flight crew, third-party liability, aircraft insurance, fuel, and lubricants.
    • Salaries and allowances of the flight crew.
    • Aircraft maintenance costs, support costs, and various fees or taxes paid in relation to the Service.
All other costs not covered by the price will be borne by the client. De-icing fees will be charged according to the airport’s applicable rate. The client is responsible for their own transportation to and from the airport. AOM may adjust the price in case of fuel cost increases, extra landing fees, extended operating hours, or additional insurance for high-risk countries. Special items, such as specific catering, are subject to a separate proposal. Unexpected operational costs or additional airport taxes will be billed to the client. No compensation is given if the number of passengers is lower than agreed. AOM may charge extra for each additional passenger.

  3. Payment Terms: After signing the contract and the General Terms and Conditions, the client must make the following payments:
    • 25% of the total amount within 24 hours after signing.
    • 50% of the total amount 10 days before the flight.
    • 100% of the total amount 72 hours before the flight.
For payments by credit card, 3% of the total price will be charged. These payments confirm the firm reservation of the aircraft. Without payment, the aircraft is not reserved. AOM may cancel the order if payments are not received within deadlines, and penalties will apply.

  4. Cancellation or Delay by the Client: If the client cancels a flight covered by this agreement, the following fees apply:
    • 25% of the charter price if cancelled after exchanging contracts.
    • 50% if cancelled within 7 days before the scheduled departure time (STD).
    • 75% if cancelled 72 hours before the STD.
    • 100% if cancelled within 24 hours before the STD.
Payment must be received by AIR OCEAN MAROC before the STD.

  5. Onboard Service: Standard services include: coffee, tea, pastries or sweet/savory snacks, daily press, drinks, and refreshments. Specific catering requests must be made at least 24 hours before departure and are subject to a separate proposal.

  6. Dangerous Goods: Passengers are not allowed to transport dangerous goods by air according to IATA standards.

  7. Baggage: AOM reserves the right to determine the quantity of baggage or cargo allowed. AOM may inspect baggage for safety reasons.

  8. Flight Cancellation: In case of adverse weather conditions, technical issues, or unforeseen problems beyond AOM’s control, AOM reserves the right to reschedule or cancel the flight.

  9. Proposal Validity: Unless otherwise agreed in writing, this proposal is valid for 7 days.

  10. Personal Data Protection: No personal data is collected without your knowledge. Air Ocean Maroc ensures that data collection and processing comply with Law No. 09-08 on the protection of individuals regarding personal data processing.
